CEREBOS AUSTRALIA LIMITED “GRAVOX® $250 VOUCHER” PROMOTION

Conditions of Entry

  1. Information on how to enter and prizes form part of these conditions of entry.
    Submission of an entry is deemed acceptance of these conditions of entry.
  2. Entry is only open to Australian residents.
  3. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Promotion commences 06/07/09 and ends for purchases made by close of business on 30/08/09. The draws will take place at Handling Matters, Unit 1, 3 Green Street, Brookvale NSW 2100, at 12 noon on the following dates: 16/07/09, 23/07/09, 30/07/09, 06/08/09, 13/08/09, 20/08/09, 27/08/09 and 07/09/09. Entries close for each draw last mail received on the Wednesday prior to the draw, except in the case of the final draw, where entries will close last mail received on 02/09/09. All non-winning entries will rollover into any subsequent draw(s). Winners will be notified by mail.
  5. To be eligible to enter, entrants must purchase any two (2) of the following products in a single transaction:
    • Gravox® Sachets (29g) – Lamb & Rosemary, Diane, Mushroom & Garlic, Supreme Roast Meat, Supreme Chicken, Pepper, White, Cheese, Chicken with Sage & Onion and Brown Onion with Garlic;
    • Gravox® Powders (200g) – Traditional, Supreme, Fuller Flavour, Lite Supreme and Chicken;
    • Gravox® Powders (425g) – Traditional, Supreme, Fuller Flavour and Lite Supreme;
    • Gravox® Gravy (U.H.T 375ml) – Classic Sauces - Roast Meat;
    • Gravox® Liquid Gravies and Sauces (165g) – Traditional, Roast Meat with Red Wine & Garlic, Chicken with White Wine, Lamb & Rosemary, Brown Onion, Creamy Mushroom & Bacon, Pepper Steak, Diane, Mushroom & Garlic, Roast Chicken with Herbs, Roast Pork, Chargrilled Beef;
    • Gravox® Liquid Gravies and Sauces Family Pack (250g) – Traditional, Roast Chicken with Herbs, Lamb & Rosemary;
    • Gravy & Sauce Canisters (120g) – Roast Meat, Brown Onion, Chicken, Traditional, Lamb & Rosemary, Cheese, Diane and White;
    • Gravy & Sauce Canisters (140g) – Pepper;
    • Gravox® Liquid Stocks (1L) – Real Chicken Stock, Real Salt Reduced Chicken Stock, Real Beef Stock and Real Vegetable Stock;
    • Gravox® Liquid Stocks (500ml) – Real Chicken Stock, Real Beef Stock and Real Vegetable Stock; and
    • Gravox® Gourmet Liquid Gravies and Sauces – (165g) – Roast Beef with Shiraz, Peppercorn with Cream, Mushroom Trio and Lamb with Ironbark Honey;
    from any participating Franklins store in NSW, Foodlands store in SA or independent grocery store nationally between 06/07/09 and close of business on 30/08/09 (“Promotional Period”).
  6. To enter, entrants must then complete the official entry form found in participating stores (including providing the last 4 digits of the product barcodes), and attach their original purchase receipt(s) (clearly showing the products purchased, store, date and time of purchase) and send together to either:
    • ‘Gravox® Franklins Grocery Voucher Promotion’, P.O. Box 548, Eastern Suburbs, NSW 2004 (for purchases made at participating Franklins stores in NSW);
    • ‘Gravox Foodlands Grocery Voucher Promotion’ P.O. Box 548, Eastern Suburbs, NSW 2004 (for purchases made at participating Foodlands stores in SA); and
    • ‘Gravox® Independents Grocery Voucher Promotion’, P.O. Box 548, Eastern Suburbs, NSW 2004 (for purchases made at participating independent stores nationally).
    Final entries close last mail received on 02/09/09.
  7. Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  8. Incomplete, indecipherable or illegible entries will be deemed invalid.
  9. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with the entry requirements.
  10. The Promoter’s decision is final and no correspondence will be entered into.
  11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  12. Entries will be divided into the following groups:
    • Franklins in NSW;
    • Foodlands in SA; and
    • aIl Independents nationally.
    There will be one (1) winner drawn from the Franklins group in NSW and the Foodlands group in SA, in each weekly prize draw. Entries in the independents groups will be divided into State/Territory groups as follows: NSW/ACT, VIC, TAS, SA/NT, QLD and WA. There will be one (1) winner drawn from each State/Territory group per week, with a total of six (6) winners each week.
    The first valid entry drawn in each weekly prize draw, from the participating Franklins stores in NSW will receive a $250 Franklins voucher. The first valid entry drawn in each weekly prize draw, from the participating Foodlands stores in SA will receive a $250 Foodlands voucher. The first valid entry drawn in each weekly prize draw in each State/Territory group (NSW/ACT,VIC, TAS, SA/NT, QLD and WA) from all other participating independent stores nationally will receive a $250 voucher for the store in which the entrant made the winning purchase.
  13. Total prize pool value is $16,000.00; $ 2,000.00 in Franklins grocery vouchers in NSW, $2,000.00 in Foodlands grocery vouchers in SA and $12,000.00 in independent stores’ vouchers divided between six (6) State/Territory groups (NSW/ACT, VIC, TAS, SA/NT, QLD and WA).
  14. The maximum potential prize pool value that can be won by all:
    • NSW residents is up to $4,000.00
    • SA residents is up to $4,000.00
    • VIC residents is up to $2,000.00
    • NT residents is up to $2,000.00
    • QLD residents is up to $2,000.00
    • ACT residents is up to $2,000.00
    • TAS residents is up to $2,000.00
    • WA residents is up to $2,000.00
  15. Any costs in excess of the value of the voucher (GST inclusive) and all ancillary costs associated with redeeming the prize are not included and are the responsibility of the winner. If the goods or services for which the voucher is redeemed by the winner are less than the value of the voucher, the balance of the voucher will not be awarded as cash.
  16. The Promoter shall not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.
  17. Redemption of the voucher is subject to any terms and conditions specified on the voucher and to the voucher issuer’s standard terms and conditions.
  18. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
  19. Subject to the unclaimed prize draw clause, if for any reason whatsoever a prize winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu.
  20. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with an alternative prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  22. If required, an unclaimed prize draw may take place on 07/12/09 at the same time and place as the original draw, subject to any directions from a regulatory authority.
  23. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax implications; and/or (f) use of a prize.
  25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  26. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. If an entrant “opts in” at the time of entry, the Promoter may also use the information, for an indefinite period unless otherwise advised, for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
  27. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter/Prize Supplier/organisers in their absolute discretion including but not limited to a legal release and indemnity form.

    If any provision of the Terms & Conditions is adjudged to be invalid, void, or unenforceable, the parties agree that the remaining provisions hereof will not be affected thereby, and that the provision in question may be replaced by the lawful provision that most nearly embodies the original intention of the parties, and that the remaining Terms & Conditions for the Site will in any event remain valid and enforceable. In cases where the applicable law does not allow the restriction, limitation or exclusion of liability, Cerebos' total liability to you, in respect of all information, representations and warranties contained in the Site, shall in no event exceed the total amount paid by you to access the Site.

    GOVERNING LAW

    These Terms & Conditions are governed by laws of Australia and you hereby submit to the non-exclusive jurisdiction of the courts of Australia. No person or entity which is not a party to this agreement shall have any rights pursuant to any law or regulation to enforce any of the terms of this Agreement, save for our licensors, suppliers, vendors, Affiliates and Agents who may each do so severally and in its own right.

    Cerebos Australia Limited “Gravox® $250 Voucher” Promotion

    Conditions of Entry

    1. Information on how to enter and prizes form part of these conditions of entry.

      Submission of an entry is deemed acceptance of these conditions of entry.

    2. Entry is only open to Australian residents.

    3. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

    4. Promotion commences 06/07/09 and ends for purchases made by close of business on 30/08/09. The draws will take place at Handling Matters, Unit 1, 3 Green Street, Brookvale NSW 2100, at 12 noon on the following dates: 16/07/09, 23/07/09, 30/07/09, 06/08/09, 13/08/09, 20/08/09, 27/08/09 and 07/09/09. Entries close for each draw last mail received on the Wednesday prior to the draw, except in the case of the final draw, where entries will close last mail received on 02/09/09. All non-winning entries will rollover into any subsequent draw(s). Winners will be notified by mail.

    5. To be eligible to enter, entrants must purchase any two (2) of the following products in a single transaction:

      from any participating Franklins store in NSW, Foodlands store in SA or independent grocery store nationally between 06/07/09 and close of business on 30/08/09 (“Promotional Period”).

    6. To enter, entrants must then complete the official entry form found in participating stores (including providing the last 4 digits of the product barcodes), and attach their original purchase receipt(s) (clearly showing the products purchased, store, date and time of purchase) and send together to either:

      • Gravox® Franklins Grocery Voucher Promotion’, P.O.Box 548, Eastern Suburbs, NSW 2004 (for purchases made at participating Franklins stores in NSW);
      • Gravox Foodlands Grocery Voucher Promotion’ P.O. Box 548, Eastern Suburbs, NSW 2004 (for purchases made at participating Foodlands stores in SA); and
      • Gravox® Independents Grocery Voucher Promotion’, P.O. Box 548, Eastern Suburbs, NSW 2004 (for purchases made at participating independent stores nationally).

      Final entries close last mail received on 02/09/09.

    7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

    8. Incomplete, indecipherable or illegible entries will be deemed invalid.

    9. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with the entry requirements.

    10. The Promoter’s decision is final and no correspondence will be entered into.

    11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

    12. Entries will be divided into the following groups:

      • Franklins in NSW;
      • Foodlands in SA; and
      • aIl Independents nationally.

      There will be one (1) winner drawn from the Franklins group in NSW and the Foodlands group in SA, in each weekly prize draw. Entries in the independents groups will be divided into State/Territory groups as follows: NSW/ACT, VIC, TAS, SA/NT, QLD and WA. There will be one (1) winner drawn from each State/Territory group per week, with a total of six (6) winners each week.

      The first valid entry drawn in each weekly prize draw, from the participating Franklins stores in NSW will receive a $250 Franklins voucher. The first valid entry drawn in each weekly prize draw, from the participating Foodlands stores in SA will receive a $250 Foodlands voucher. The first valid entry drawn in each weekly prize draw in each State/Territory group (NSW/ACT,VIC, TAS, SA/NT, QLD and WA) from all other participating independent stores nationally will receive a $250 voucher for the store in which the entrant made the winning purchase.

    13. Total prize pool value is $16,000.00; $ 2,000.00 in Franklins grocery vouchers in NSW, $2,000.00 in Foodlands grocery vouchers in SA and $12,000.00 in independent stores’ vouchers divided between six (6) State/Territory groups (NSW/ACT, VIC, TAS, SA/NT, QLD and WA).

    14. The maximum potential prize pool value that can be won by all:

      • NSW residents is up to $4,000.00
      • SA residents is up to $4,000.00
      • VIC residents is up to $2,000.00
      • NT residents is up to $2,000.00
      • QLD residents is up to $2,000.00
      • ACT residents is up to $2,000.00
      • TAS residents is up to $2,000.00
      • WA residents is up to $2,000.00
    15. Any costs in excess of the value of the voucher (GST inclusive) and all ancillary costs associated with redeeming the prize are not included and are the responsibility of the winner. If the goods or services for which the voucher is redeemed by the winner are less than the value of the voucher, the balance of the voucher will not be awarded as cash.

    16. The Promoter shall not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.

    17. Redemption of the voucher is subject to any terms and conditions specified on the voucher and to the voucher issuer’s standard terms and conditions.

    18. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.

    19. Subject to the unclaimed prize draw clause, if for any reason whatsoever a prize winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu.

    20. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with an alternative prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

    21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

    22. If required, an unclaimed prize draw may take place on 07/12/09 at the same time and place as the original draw, subject to any directions from a regulatory authority.

    23. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

    24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax implications; and/or (f) use of a prize.

    25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

    26. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. If an entrant “opts in” at the time of entry, the Promoter may also use the information, for an indefinite period unless otherwise advised, for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

    27. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter/Prize Supplier/organisers in their absolute discretion including but not limited to a legal release and indemnity form.
